Terms of Service ("ToS" or "Agreement")
This Terms of Service ("ToS" or "Agreement") governs the use of services (the "Expedify Service") offered by Expedify Ltd (including its subsidiaries), hereinafter referred to as the "Company". The Company is incorporated under the laws of India, with its registered office at [Insert Address Here]. By using the Expedify Service, you explicitly agree to these ToS and the attached Privacy Policy ("PP"). Your acceptance irrevocably binds you to comply with all obligations and conditions stated herein unless explicitly made optional. Definitions
- Platform: Refers to the website, dashboard, Expedify, and any other medium that provides access to Expedify Services.
- Company, we, us, or our: Includes Brainpan Digital Private Limited, its subsidiaries, and affiliates.
- Expedify Content: Encompasses all proprietary ideas, concepts, systems, software, interfaces, and other intellectual property owned, developed, or licensed by Expedify. It excludes Customer Data.
- Customer Data: Refers to electronic data or content submitted by or on behalf of a Customer for storage, collection, or processing using Expedify Services.
- Data Point/Event: Includes session starts, ends, custom events, purchases, or any other custom recordings. Automatically collected data like push tokens or engagement tracking is not included as Data Points.
- Documentation: Includes guides and user documentation provided to Customers in electronic or other forms.
- End User: Any user of a Customer"s platforms, goods, or services.
- Message: Communications made by a Customer to an End User via Expedify Services (e.g., email, SMS, push notifications).
- Monthly Active Users (MAU): The number of End Users recording any Data Point during a billing period.
- Report Template: The design and formatting of reports provided to the Customer containing their data.
- Expedify Libraries/Code: The code developed and maintained by Expedify for integration into Customers" platforms.
- You/Customer: Any individual or entity authorized to use Expedify Services.
Updation of Terms
These ToS may be updated or revised periodically. Any updates will be communicated via email, and your continued use of the services will require your consent. We encourage you to review the ToS regularly. These ToS may be updated, amended, or modified at the sole discretion of the company, Brainpan Digital Private Ltd, without prior notice. However, any changes related to pricing will be explicitly communicated to users before taking effect.
Service(s) Provided
The Company offers the following key features:
- End-User behavior tracking and analytics.
- Customizable messaging across multiple channels.
- Personalized messaging and content delivery.
- End-User segmentation and classification.
The Company may modify or discontinue features or services at its sole discretion. Customers are responsible for securing their accounts and ensuring the accuracy of their account information. The Company is not liable for unauthorized account access unless explicitly reported by the Customer.
Registration and Account Integrity
During registration, Customers must provide accurate information, including a name and email ID, and set a secure password. Misleading or inappropriate account credentials are prohibited. The Company may track IP addresses for security purposes.
Use of Information and Content
Customers are responsible for ensuring that data shared with Expedify complies with legal and ethical standards. Expedify will use this data strictly as permitted by applicable laws and the Privacy Policy.
Third-Party Services
The Company collaborates with third-party providers to deliver Expedify Services. While efforts are made to ensure data confidentiality, Customers bear responsibility for their engagements with third-party services.
Rules and Conduct
Customers must not:
- Violate laws or third-party rights.
- Abuse or overload the platform.
- Attempt to reverse-engineer or misuse Expedify Services.
- Distribute or copy Expedify Content without authorization.
Non-compliance may result in account suspension or termination.
Content Ownership and Copyright
Expedify retains ownership of all proprietary content. Customers retain ownership of their data but are responsible for its compliance with confidentiality and intellectual property laws.
Support
Email-based support is available for all queries at [Insert Email Here]. Expedify will make reasonable efforts to resolve issues but does not guarantee uninterrupted services.
Termination
The Company may terminate accounts for violations of the ToS or other reasons. Post-termination, all associated data will be deleted within 14 days, unless required otherwise by law.

Expedify Services are provided "as is" without warranties of any kind. The Company is not liable for indirect damages, including data loss or loss of opportunity.
Governing Law
This Agreement is governed by Indian law. All disputes are subject to the exclusive jurisdiction of courts in Gurugram, Haryana.
Miscellaneous
The ToS constitutes the entire agreement between the Customer and the Company. Amendments require explicit written consent. Notices will be deemed delivered upon confirmation of receipt.
